Background
For export-oriented manufacturers, a third-party workplace compliance review can carry real commercial weight, particularly when its findings reach international buyers. M&C’s Corporate Team advised a multinational apparel manufacturer based in China, with a significant global presence, on the legal assessment of an independent workplace compliance review concerning its Bangladesh operations. The review recorded findings across labour practices, occupational safety and health, wage administration, industrial relations and regulatory licensing. Following remedial measures by the manufacturer and a reassessment by the assessor, a progress letter was issued.
The manufacturer sought an independent legal assessment of the reported findings. Our work involved a detailed, finding-by-finding review of the assessor’s progress record, the supporting documents maintained by the manufacturer and the legal provisions cited in the report. The review covered applicable labour and employment laws, workplace policies and practices, occupational safety and health requirements, working-time regulations, wage and benefits obligations, freedom of association and other regulatory requirements relevant to Bangladesh’s ready-made garment (RMG) sector.
Review of the Legal Basis
Our review involved a detailed examination of the primary text of each cited provision, including the Labour Act, the Labour Rules, other sector-specific legislation, ILO instruments, national policies and technical guidelines. For each reported finding, we assessed whether the cited provision supported the interpretation adopted by the assessor. In several instances, the applicable legal position was more nuanced than the report suggested. This analysis enabled us to evaluate the findings against the relevant legal framework, identify potential compliance risks and highlight matters requiring further clarification.
Our review also involved a detailed assessment of the supporting evidence. We examined the dated records, notices, registers and approvals provided by the manufacturer and linked each corrective measure to the specific requirement it addressed. The resulting opinion was measured and evidence-led, reflecting the need for a legal assessment that would be credible and persuasive to international buyers.
Regulatory Approvals and Processing Timelines
Our review also considered the allocation of responsibility for regulatory approvals and the applicable processing timelines. We distinguished between licences or clearances pending with government authorities and those for which no application had been made, taking into account the prescribed processing periods and the manufacturer’s follow-up measures. We also gave appropriate weight to items that the assessor had recorded as completed.
The engagement reflects M&C’s experience in employment law, regulatory compliance and Bangladesh’s RMG industry, as well as our commitment to providing informed, commercially relevant legal guidance on complex workplace compliance matters.
