M&C represented two sons and two daughters of Kazi Shamsul Haque, established businessman and founding owner of the renowned Lakeshore Hotel, in a habeas corpus matter.
In a significant habeas corpus matter, a Division Bench of the High Court Division has confirmed the right of the two sons and two daughters of Kazi Shamsul Haque, founding owner of the renowned Lakeshore Hotel in Gulshan, to have access to and provide care for their ailing and elderly father.
Following lengthy hearing, the Bench comprising Mr. Justice Md. Habibul Gani and Mr. Justice Sk. Tahsin Ali delivered its short judgment on 18 February 2026, with the full judgment published on 30 July 2026. The Court’s directions ensure that the petitioners may henceforth meet their father, maintain contact with him, and attend to his wellbeing without unlawful obstruction.
The writ petition was brought by Mr. Haque’s four children, Kazi Farhana Jahan, Kazi Farzana Rahman, Kazi Rashedul Haque and Kazi Ashfaq Shams, who alleged that their brother had exploited their father’s dementia and other age-related illnesses to unlawfully assume exclusive control over various movable and immovable properties. The petitioners further alleged that he had been preventing them from meeting or communicating with their father and from providing him with necessary care and attention.
Allowing the petition, the High Court directed that the petitioner sons and daughters are entitled to visit their father, wherever he may be residing, to meet with him, and to provide him with services, care and appropriate attention. The Court issued a clear injunction that no individual or party may create any obstruction, impediment, or interference with such visits, communications, or the petitioners’ efforts to care for their father.
The judgment further stipulates that, should the petitioners face any obstruction while attempting to visit or care for their father, the Officer-in-Charge of the relevant police station must extend the necessary legal assistance to them. At the same time, the Court cautioned all parties to refrain from disputes, confrontations or provocative conduct so as not to disturb the peaceful and dignified life of the elderly father.

The decision effectively restores, after nearly two and a half years, the petitioners’ right to be physically present with their father and to participate directly in his care, treatment and overall wellbeing.
